Woman restoring her maiden name after divorce with updated Aadhaar, PAN and passport in India
Quick Answer

Yes, you can legally change your name after divorce in India. The law recognises your right to choose your own name. You can revert to your maiden name, keep your married surname, or adopt a new name. To make it official, you complete three steps: a sworn affidavit, a newspaper advertisement, and a Government Gazette notification. A divorce decree by itself does not change your name, so this process is what updates your Aadhaar, PAN, passport and other records.

Your Choices

The Legal Route

The Central Gazette Process for a Name Change

Your divorce name change becomes official once it is published in the Central Gazette of India.

The Gazette of India is the official public journal of the Government of India, and your name change notice is published in Part IV. It is run by the Department of Publication, Controller of Publications, in Civil Lines, Delhi. Since 2026 the process runs mostly on the e-Gazette platform, where the digital copy carries the same legal weight as a printed one.

For the Central Gazette, your file is sent to the Controller of Publications in Delhi with your notarised affidavit, the original newspaper cuttings, the filled application form, a soft copy of the notice, the fee receipt and two passport photographs. The Gazette is published weekly, usually on a Saturday, after which you download your copy from the official e-Gazette portal. We prepare and file this whole package for you.

Fee and timeline: the Government Gazette fee is paid online through BharatKosh, Rs 1,100 for an adult and Rs 1,700 for a minor. Publication usually takes four to six weeks. To avoid an objection, your name must be spelt exactly the same across the affidavit, the newspaper advertisement and the application form.
Why It Matters

Benefits of a Central Gazette Notification

The Central Gazette gives your new name the widest legal acceptance in India.

🌐

Valid across all of India, unlike a State Gazette that works only within one state.

🏦

Accepted Everywhere

The passport office, UIDAI for Aadhaar and banks accept the Central Gazette as proof.

📜

Lifetime Legal Proof

A permanent record of your name change for service records, verification and visas.

🔄

Easy Document Updates

Update Aadhaar, PAN, passport and bank records smoothly with the Gazette copy.

Works for Every Situation

Marriage, divorce, spelling correction or personal choice, the same route applies.

🛡️

Protects Against Fraud

An official public record that helps prevent misuse of your old or new identity.

People Also Ask

Name Change After Divorce in India, Frequently Asked Questions

Clear answers to the questions we hear most often.

Does a divorce decree automatically change my name?
No. A divorce decree only ends the marriage. To legally change your name, you still need the affidavit, newspaper advertisement and Gazette notification. The decree is useful as supporting proof, but it does not change your name on its own.
Is it mandatory to change your name after divorce?
No. Changing your name after divorce is entirely your personal choice. You can keep your married surname, revert to your maiden name, or adopt a new name.
Can I keep my married surname after divorce?
Yes. You have every right to keep your married surname. No action is needed and no one can force you to change it.
Can men change their name after divorce too?
Yes. The right to change your name applies to everyone. Men can also revert to an earlier name or adopt a new one through the same process.
Do I need the divorce decree to change my name?
The name change is your legal right through the affidavit, newspaper advertisement and Gazette route. Attaching the divorce decree explains the reason and makes approval smoother, so we recommend including a copy.
How long does it take and what does it cost?
Most cases are completed within three to seven weeks. Our service fee starts at Rs 1,999, and the Government Gazette fee is Rs 1,100 for an adult, paid separately.
How do I change a child's name after divorce?
A minor's name change is more sensitive. It usually needs the consent of both parents, or a court order if one parent does not agree. The same affidavit, newspaper and Gazette process then follows.
