A name change affidavit is a sworn declaration on non-judicial stamp paper, signed before a Notary Public, stating that your old name and new name belong to one person. It is the first of three steps. On its own it is not full proof of a name change, and the newspaper notice and Gazette notification complete it.

Many Affidavits Still Quote A Law That No Longer Exists
Every name change affidavit ends with a line saying that the person understands a false declaration is punishable. For decades that line cited the Indian Penal Code, usually Section 199. The Indian Penal Code of 1860 was repealed and replaced by the Bharatiya Nyaya Sanhita, 2023, which came into force on 1 July 2024. The corresponding provision for a false statement made in a declaration receivable as evidence is now Section 236 of the Bharatiya Nyaya Sanhita, with giving false evidence at Section 227 and punishment for false evidence at Section 229.
Draft templates circulating online have not caught up. Sample formats published well over a year after the change still print the old citation. In practice a notary is unlikely to reject an affidavit over an outdated reference, and the declaration itself still binds you either way. But it tells you something about who prepared the document. If the person drafting your affidavit is working from a template last checked before July 2024, that same template is probably out of date in other places too, and some of those places do get files returned.

What a Name Change Affidavit Must Contain
There Is No One Government Format, And That Matters
People search for the name change affidavit format expecting one official document issued by the Government of India. There is no single universally mandated central format. What exists instead is a widely used structure, plus individual authorities that publish their own required wording. A passport office may want its own proforma. The Unique Identification Authority of India has its own expectations for Aadhaar. A school board, a bank or a provident fund office may each ask for something slightly different.
That is why downloading a generic sample and taking it to a notary is a gamble. The affidavit may be perfectly valid as a legal instrument and still be handed back by the one office you actually needed it for, because it does not carry the wording that office insists on. The useful question is not what the format is. It is which authority is going to read this affidavit first. We ask that before drafting, and where an authority publishes its own proforma we use that one rather than ours.

You Cannot Complete an Affidavit Entirely Online
A great deal is advertised as an online affidavit, and part of it genuinely is online. The drafting can be done remotely, the stamp paper can be arranged, and the finished document can be delivered to you. What cannot be done remotely is the attestation. An affidavit becomes a sworn instrument when you sign it in the presence of a Notary Public, First Class Magistrate or Oath Commissioner, who verifies your identity, watches you sign and then applies a seal and register entry. That step needs you to be physically present.
So when a service says the whole thing is online, read carefully. If they mean everything up to the notary appointment, that is honest and useful. If they imply you will never have to appear anywhere, that is not how a sworn declaration works in India. We handle the drafting, the stamp paper and every stage after notarisation, entirely online. The notary appointment itself is the one part that needs you, and it usually takes under an hour in your own town. Anyone abroad signs before an Indian Embassy or High Commission instead.
An Affidavit Alone Is Usually Not Enough
This is the part that costs people the most time. A notarised affidavit is a sworn statement by you about yourself. It is not a public record and it is not a government declaration that your name has changed. A handful of situations accept it on its own. Most do not. Passport offices, banks, school and university boards, provident fund offices and property registries generally want to see the newspaper notices and the published Gazette notification as well, because those create a public record that anybody can verify.
The practical failure looks like this. Somebody gets an affidavit made, updates one or two easy records with it, and assumes the job is finished. A year later a passport renewal or a background check asks for the Gazette, and by then the newspaper notices should have been placed at the same time as the affidavit, quoting its date. Starting over means a fresh affidavit and fresh notices. The affidavit starts the process. The Gazette completes it. Doing both together is cheaper than doing one twice.
